Terms and Conditions

3.1 Account Creation

You must create an account to access the Service. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.2 Age Requirement

You must be at least 16 years old to use this Service. By using the Service, you represent that you meet this age requirement.

3.3 Intended Use

This Service is intended for personal language learning use. It is not certified for educational institutions or professional certification purposes.

4.1 Pricing and Payment

• Premium subscription costs €10 per month
• Payment is processed through Stripe
• For users outside the EU, Stripe automatically converts pricing to local currency
• Subscriptions are billed on a recurring monthly basis
• Payment is charged at the beginning of each billing cycle

4.2 Auto-Renewal

Your Premium subscription will automatically renew each month unless cancelled before the next billing date.

4.3 Cancellation

• You may cancel your Premium subscription at any time through your account settings via our Stripe integration
• Cancellation takes effect at the end of your current billing period
• You will retain Premium access until the end of the paid period
• No refunds are provided for partial months after the withdrawal period

4.4 Free Trial and Upgrades

• The Basic Plan is free to use indefinitely
• You may upgrade to Premium at any time
• Downgrading to Basic retains your account but removes Premium features

5.1 14-Day Withdrawal Right

As a consumer in the European Union, you have the right to withdraw from your Premium subscription purchase within 14 days without giving any reason. The withdrawal period expires 14 days from the day you purchased the Premium subscription.

5.2 Exercising Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by:

• Or through your account cancellation settings

You may use the model withdrawal form below, but it is not obligatory.

5.3 Effects of Withdrawal

If you withdraw from your subscription within the 14-day period, we will reimburse all payments received from you without undue delay and in any event not later than 14 days from the day we receive notice of your withdrawal.

5.4 Early Commencement of Service

If you request that Premium service begins immediately upon purchase (before the 14-day withdrawal period expires), you acknowledge that your right of withdrawal expires once the service has been fully performed.

6.1 Ownership

All content, features, functionality, software, audio materials, text, graphics, logos, and other materials on the Service are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms.

6.3 Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the Service
• Reverse engineer or attempt to extract the source code
• Remove any copyright or proprietary notices
• Use the Service for any commercial purpose without our written consent
• Share Premium account credentials with others

7.1 Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful code, viruses, or malicious software
• Attempt to gain unauthorized access to the Service or related systems
• Use automated systems (bots, scrapers) to access the Service
• Engage in fraudulent payment activities or chargebacks
• Harass, abuse, or harm other users or our staff
• Share or sell your Premium account access

7.2 Our Right to Terminate

• Suspend or terminate your account immediately for serious violations (fraud, illegal activity, security threats)
• Issue warnings and suspend accounts for other violations
• Terminate accounts that remain inactive for extended periods
• Refuse service to anyone at our discretion

7.3 Effect of Termination

• Upon termination: Your access to the Service will cease immediately
• No refunds will be provided for terminated accounts
• We may delete your account data in accordance with Section 9

9.1 Account Deletion

You may delete your account at any time through your account settings or by contacting us.

9.2 Data Deletion

• Upon account deletion: Your personal data will be permanently deleted within 30 days
• Billing records will be retained for 10 years as required by German tax law (HGB, AO)
• Anonymized usage statistics may be retained for service improvement

9.3 Backup Retention

Deleted data may persist in backup systems for up to 90 days before permanent removal.

10.1 "As-Is" Service

The Service is provided on an "as-is" and "as-available" basis. We strive to provide a reliable and high-quality service but make no guarantees regarding:

• Uninterrupted or error-free operation
• Service availability or uptime
• Accuracy or completeness of content
• Compatibility with all devices or browsers

10.2 Maintenance and Updates

We reserve the right to:

• Perform maintenance that may temporarily interrupt service
• Modify, update, or discontinue features
• Change the Service without prior notice (though we will attempt to notify users of significant changes)

10.3 No Educational Certification

This Service is not certified for educational institutions, professional credentials, or language proficiency certification.

11.1 Statutory Liability

Nothing in these Terms shall exclude or limit our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Intentional misconduct or gross negligence (Vorsatz oder grobe Fahrlässigkeit)
• Breach of essential contractual obligations (wesentliche Vertragspflichten)
• Any liability that cannot be excluded under German law

11.2 Limited Liability

To the extent permitted by German law, we shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or technical failures
• Any damages arising from your use or inability to use the Service

11.3 Maximum Liability

Where we are liable for breach of essential contractual obligations without intentional misconduct or gross negligence, our liability is limited to foreseeable, typical damages. In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim.

12.1 Modification Rights

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service.

12.2 Notification

For material changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify users via email or in-app notification where practical
• Provide reasonable notice before changes take effect

12.3 Continued Use

Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Service.

13.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflicts of law provisions.

13.2 Jurisdiction

The courts of Bremen, Germany shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Service.

13.3 EU Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), available at: https://ec.europa.eu/consumers/odr/

We are committed to resolving any concerns directly with our customers. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board.
